Noire Bets — Terms of Service (AGB)

These Terms of Service (the “Terms”) govern your access to and use of Noire Bets’ websites, landing pages, Telegram channels (Free and Premium), bots, emails, and any related content or services (collectively, the “Service”). By subscribing, purchasing, or accessing the Service, you agree to these Terms.

VAT: No VAT charged pursuant to § 19 UStG (Kleinunternehmer), where applicable.

You must publish a legally compliant Impressum for users in Germany/Austria. If your Impressum is separate, link it clearly on your landing page.

2. What we do (Nature of the Service)

Noire Bets provides informational sports analysis and betting opinions only. We do not operate as a bookmaker, we take no stakes, and we never accept customer funds for wagering. All content is for entertainment and educational purposes and does not constitute financial, legal, or investment advice. Any decisions to place bets are your sole responsibility.

You must be 18+ (or older if your jurisdiction requires) and you must comply with local laws and platform rules. Access may be geo‑restricted where sports‑betting content is illegal.

3. Accounts, access, and eligibility

You are responsible for maintaining the confidentiality of your access (Telegram username, email, devices). One seat = one person.

Sharing, forwarding, scraping, re‑posting, or reselling our content is strictly prohibited.

We may suspend or terminate access for suspected abuse, redistribution, or breach of these Terms.

4. Plans, prices, and taxes

Plan names and durations: Monthly, Quarterly, Semi‑Annual, Annual, 7‑Day Kickoff (trial/short plan).

Prices are shown in EURO (€) and may include or exclude VAT depending on your location. Where applicable, taxes are added at checkout. (No VAT charged pursuant to § 19 UStG)

Prices may change from time to time. Any change for auto‑renewals will be notified in advance and will apply from your next billing period.

5. Billing, auto‑renewal, cancellation

Subscriptions auto‑renew at the end of each term unless cancelled.

You can cancel at any time before the renewal date via InviteMember, Telegram-Bot or message us on Telegram. Cancellation stops future renewals; it does not retroactively refund the current period except where expressly stated in these Terms or required by law.

Payments are processed by Stripe. We do not store full card details on our servers.

6. EU consumer information & withdrawal (Widerruf)

If you are an EU/EEA consumer purchasing digital content, you: (a) explicitly request and consent to the immediate start of the Service; and (b) acknowledge that once delivery begins you lose the 14‑day right of withdrawal under the Consumer Rights Directive, except where delivery has not started.

This does not affect any mandatory consumer rights you may have under your local laws.

7. Fair‑Play Guarantee (Make‑Good Policy)

What it covers. Singles only. Pushes don’t count. Combos/Riskies are excluded. A week means Monday–Sunday (CEST). A qualifying week has ≥ 10 official Singles posted in the Premium channel.

Trigger. If, within your guarantee window, any one Monday–Sunday week of our official Singles finishes below 50% wins (pushes excluded) and the week had ≥ 10 Singles, you may choose one make‑good for your current plan.

Guarantee windows by plan:

Monthly: first 14 days of your current paid term.

Quarterly: first 28 days of your current paid term.

Semi‑Annual & Annual: first 56 days of your current paid term.

7‑Day Kickoff: extension only (+7 days); no cash refunds.

Join mid‑week? The guarantee evaluates the official Monday–Sunday week during which you joined. That ongoing week does count toward your guarantee window if it otherwise meets the criteria above.

Your choices when triggered:

Monthly: 100% refund of the current month or +30 days added to your access.

Quarterly: 100% refund of the current quarter or +30 days added.

Semi‑Annual: 100% refund of the current half‑year or +60 days added.

Annual: 100% refund of the current year or +90 days added.

7‑Day Kickoff: +7 days extension only (no cash refunds).

How to claim. Submit a ticket to noire.empire.official@gmail.com or DM us on Telegram (more information in the t.me/NoireBetsFree channel) within 7 days after the week ends. We may require your purchase email, transaction ID, and Telegram handle for verification.

Limits. One make‑good per subscriber per paid term. We may deny claims in cases of fraud, chargebacks, access‑sharing, or if you were not an active subscriber during the qualifying week. This policy is a commercial guarantee from us and does not limit your statutory rights.

8. “Playable to” & market movement

Each pick may include a “Playable to” price. If the market moves below that level before you place your bet, the pick is no‑play for you under our methodology.

We track CLV vs. closing price and publish transparent recaps (W/L/P). Past performance does not guarantee future results.

9. Responsible use & risk notice

Our Service is informational and not personalized financial advice. We make no promises of profit.

10. Intellectual Property & license

All content (copy, picks, data, graphics, brand assets) is owned by Noire Bets or its licensors and is protected by IP laws.

You receive a revocable, non‑exclusive, non‑transferable license to view our content for personal, non‑commercial use during your active subscription.

Redistribution, recording, scraping, automated harvesting, or publication of our content is prohibited without written permission.

11. Acceptable use

You agree to not:

Share or resell access or content.

Circumvent access controls, copy or scrape content, or run automated collection tools.

Harass staff or other users, or engage in unlawful activity via the Service.

We may suspend or terminate access immediately for violations.

12. Platform disclaimers

Noire Bets is independent from Telegram and any bookmaker. We are not affiliated, endorsed, or sponsored by them.

Platform outages, API limits, or third‑party changes may temporarily affect delivery. We will use reasonable efforts to restore service but are not liable for third‑party failures.

13. Availability & changes

We aim for high availability but provide the Service on an “as is” and “as available” basis. We may modify, pause, or discontinue features with reasonable notice where feasible.

14. Limitation of liability

To the fullest extent permitted by law:

We are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data.

Our total aggregate liability for any claim related to the Service is limited to the fees you paid to us in the three (3) months preceding the event giving rise to the claim.

Nothing in these Terms limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, or other liabilities that cannot be excluded by law.

15. Indemnity

You agree to indemnify and hold harmless Noire Bets and its operators from claims arising out of your breach of these Terms or misuse of the Service.

16. Data protection & privacy

We process personal data in accordance with our Privacy Policy: [Privacy Policy URL]. By using the Service, you consent to that processing. If you are in the EU/EEA/UK, we act as controller for subscription data and communications necessary to deliver the Service.

17. Termination

You may stop using the Service at any time. We may suspend or terminate access for cause (e.g., fraud, sharing, abuse, non‑payment). Upon termination, your license to access content ends immediately.

18. Governing law & venue

These Terms are governed by the laws of Germany, excluding conflict-of-law rules and the UN CISG. If you act as a business customer, the exclusive venue is Oldenburg, Germany. If you are a consumer in the EU/EEA/UK, any mandatory consumer protections and venue rules of your place of residence remain unaffected.

19. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date shows the latest version. Material changes will be notified via the Service. Continued use after updates constitutes acceptance.
